Course Description
This course is an in-depth study of the federal, state and local laws which govern the preparation and use of medical records in the health care delivery system. Topics include the medical record as a legal document and release of information.
Learning Outcomes and Objectives
- The student will demonstrate an understanding of the medical record as a legal document by:
- describing the origin of legal requirements to maintain medical records.
- applying Joint Commission on Accreditation of Healthcare Organizations (JCAHO) regulations and reasons for signatures in the medical records.
- describing what the medical record practitioner should do with incomplete records of deceased physicians.
- describing the procedure for correcting errors in the record.
- discussing statutes and/or requirements for preservation of medical records.
- defining "Statutes of Limitations" and explaining how this affects the preservation of medical records.
- explaining why retention requirements are different for minors versus adults.
- The student will demonstrate an understanding of confidential communications by:
- defining confidential and privileged communications.
- describing the confidentiality of incident reports.
- defining waiver of privilege.
- identifying legal problems that occur with computerized records.
- describing the patient's right to privacy.
- commenting on problems that include the administration of violation of confidentiality of medical records.
- The student will interpret standards for release of information by:
- differentiating between personal and impersonal uses of the medical record.
- identifying information which may be released without consent of the patient.
- describing procedures for release of information including verification of authorization, preparation of copies, charges for services.
- listing essential items to be included in a medical record abstract.
- explaining the special provisions for release of information in alcohol and drug abuse cases.
- The student will demonstrate an understanding of how medical records can be used in court proceedings by:
- identifying the courts in the state and federal judicial systems and explaining the jurisdiction of each.
- identifying quasijudicial bodies.
- naming the two parties of a lawsuit.
- defining key legal terminology.
- describing the valid service of a subpoena duces tecum.
- The student will demonstrate an understanding of the requirements of consents, authorizations and releases for information by:
- defining the following consents; informed, implied, oral express, blanket, and general.
- identifying individuals who may give consent and sign authorizations in various situations.
- giving examples of when a minor can consent to his own treatment.
- identifying procedures requiring special consents.
- defining a Medical Examiner's or coroner's case.
- explaining the Uniform Anatomic Gift Act and advance directives.
Criteria Performance Standard
Upon successful completion of the course the student will, with a minimum 78% accuracy, demonstrate mastery of each of the above stated objectives through classroom measures developed by individual instructors.
