Requisites

(Admission to Funeral Arts (Advanced Technical Certificate with Financial Aid Eligibility) (FUNAT-ATC) or
Admission to Funeral Services (Associate in Science) (FUNSE-AS)) and
Pre- or Co-requisite FSE 1150 with a minimum grade of C

Course Description

This course will include legal methods of disposition, legal responsibilities of the funeral practitioner, common and statutory laws, Florida laws regulating funeral practices and establishments, crematory and cemetery laws, and probate laws for estates.

Learning Outcomes and Objectives

  1. The student will summarize the principles of mortuary law by:
    1. defining terminology associated with funeral service law.
    2. identifying sources of funeral service law.
    3. explaining legal definitions of death.
    4. explaining obligations of disposition.
    5. identifying torts involving a dead body.
    6. explaining control and liability of disposition.
    7. explaining funeral establishment regulations.
    8. explaining cemetery and crematory regulations.
    9. explaining the laws pertaining to funeral service practice.
  2. The student will describe the functions of the licensure process for funeral directors and embalmers by:
    1. explaining universal license criteria.
    2. explaining Florida licensure requirements.
  3. The student will explain the responsibilities of a funeral director and an embalmer according to professional license by:
    1. stating the limitations imposed upon the practice of funeral director/embalmer.
    2. identifying the responsibilities of the funeral director to the families that called him/her to serve.
    3. identifying the responsibilities of the funeral director to other professionals.
  4. The student will summarize probate law by:
    1. defining the laws which govern the disposition of an estate.
    2. explaining wills.
    3. explaining the procedures of a person dying intestate.
    4. explaining the administration of an estate.
  5. The student will analyze Florida laws which regulate funeral service practice by:
    1. explaining the grounds for issuance, revocation, suspension, and renewal of Florida funeral director and embalmers license.
    2. describing the rules and regulations which affect the practice of funeral service.
    3. explaining the purpose of the board of Funeral Directors and Embalmers.
    4. explaining the laws pertaining to:
      1. transportation of human remains
      2. requirements of funeral establishments
      3. conducting funerals
      4. filing complaints concerning funeral practice
      5. provisions for reciprocity

Criteria Performance Standard

Upon successful completion of the course the student will, with a minimum of 75% accuracy, demonstrate mastery of each of the above stated objectives through classroom measures developed by individual course instructors.
